		<description>I believe you have misapplied the case to meet your needs. The Supreme Court does in fact read and interpret the law. They do not, however, create the law. Yes Marbury v. Madison calls for a broad interpretation of the Constitution, but to say that it lends the Court the power to create a system by which to measure law schools, I believe, is a misapplication of Marshall&#039;s intent. Further, Sweatt v. Painter dealt with the Fourteenth Amendment, establishing that &quot;separate but equal&quot; within law school admissions is unequal. I will give you that this is a creative way to settle a rivalry, however, I would not go as far as to say the Court set forth a measurement for Law schools.</description>

I&#039;d also add to #5 in terms of &quot;and similar activities&quot; that there are probably more students at HLS involved in (high-quality) secondary journals than there are students enrolled in YLS total.  Look beyond journals to practice organizations, etc. and the pattern of increased opportunities probably continues.</description>
